Terms of Service

1) Acceptance

By downloading, accessing, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

2) Definitions

The definitions in the Privacy Policy (Account Data, Reminder Data, Calendar Data, Memory Data, Secret Memory, Service Providers) apply to these Terms.

3) The Service

makkena is a voice-enabled personal planning and productivity tool. Core features include app-native reminders and (if you connect calendars) the ability to read and write calendar events at your direction to support end-to-end planning and informational workflows.

4) Privacy; Product Design Commitments

Our Privacy Policy is incorporated into these Terms by reference.

You acknowledge and agree that:

• makkena does not store calendar event content in makkena's database; makkena is designed to maximize planning value through on-demand access rather than retention of calendar events.
• makkena does store Account Data and Reminder Data (and certain Memory Data) in a secure cloud database operated by a well-established U.S.-based cloud provider to deliver core functionality.
• Secret Memories are designed so the external voice provider receives only Secret Memory names/labels, while secret contents are displayed only after biometric authentication in a temporary in-app modal.

5) Calendar Integrations: Read/Write Permissions and Risk of Mistakes

If you connect a calendar account, you authorize makkena to request permissions sufficient to read and write calendar events to perform actions you request (including creating, modifying, rescheduling, or deleting events).

You acknowledge that:

• Calendar write actions are inherently sensitive.
• Mistakes may occur (e.g., wrong time/date, recurrence, attendee list, calendar selection).
• You are responsible for reviewing outcomes and correcting errors.
• You may disconnect calendar access at any time.

6) Voice Features and External AI Processing

Voice interactions are processed by a well-established U.S.-based provider of AI solutions. When you use voice features, your audio is transmitted to that provider to generate responses.

makkena does not store voice audio or transcripts on makkena servers. You understand that external providers may process data under their own published policies and safety requirements, and makkena is designed to minimize transmitted data and to avoid sending Secret Memory contents.

7) Your Content

You retain ownership of your User Content, including Reminder Data and Memory Data. You grant makkena a limited, non-exclusive license to host, store, and process User Content solely to operate, maintain, and improve the Service.

8) Acceptable Use

You agree not to:

• use the Service unlawfully,
• attempt unauthorized access or interfere with the Service,
• introduce malware or harmful code,
• misuse the Service in violation of platform policies or third-party terms.

9) Suspension and Termination

You may stop using the Service at any time. We may suspend or terminate access if you violate these Terms, pose security/abuse risk, or we must do so to comply with law.

10) Disclaimer

The Service is provided "as is" and "as available." Outputs may be inaccurate or incomplete. makkena does not provide professional advice (medical, legal, financial, or otherwise).

11) Limitation of Liability

To the maximum extent permitted by law, makkena is not liable for indirect, incidental, consequential, or punitive damages. makkena's total liability for any claim relating to the Service will not exceed $100 or the amount you paid in the 12 months before the claim, whichever is greater.

12) Fees; Future Paid Plans

makkena may offer paid features in the future, including subscriptions. If purchased via Apple's App Store, auto-renewable subscriptions renew until canceled, and subscription management occurs through Apple account settings.

13) Changes

We may update these Terms. Continued use after updates constitutes acceptance.

14) Governing Law; Venue

These Terms are governed by California law. Any dispute must be brought in state or federal courts in San Francisco County, California, unless applicable law requires otherwise.
